The Supreme Court on Tuesday favoured the idea of framing some guidelines for granting Bail even after the Charge Sheet is filed only in Criminal Cases.
The Supreme Court also asked the Central Bureau of Investigation (CBI) to suggest some guidelines about the same matter.
A Bench comprising Justices Sanjay Kishan Kaul and M M Sundresh stated, “In view of the submission in Court, it is deemed appropriate that some guidelines may be laid down so that the Courts are better guided and not troubled with the aspect of bail on charge sheet being filed”.
The Apex Court stated this while it was dealing with a Plea filed by an accused in a Corruption Case, who was not Arrested during the period of Investigation but a Charge-Sheet was filed against him by CBI.
Appearing on behalf of CBI, Additional Solicitor General SV Raju said that he will propose some guidelines in this matter.
Further, Raju added that he is going to discuss the same matter with Senior Advocate Siddharth Luthra, who was appearing on the behalf of one of the Accused, Satendar Kumar Antil.
The Apex Court has also restrained a third-party intervention in this matter saying that it is trying to set some legal principles.
The Court also stated that it would be better and appreciated if the intervenors give some suggestions to General SV Raju.
For now, the matter is adjourned and the next hearing will be on October 5.
