The three-member Judicial Commission formed to investigate the killing of gangster Vikas Dubey gave a ‘clean chit’ to the Uttar Pradesh (UP) Police.
The Commission headed by retired Supreme Court Judge Justice B S Chauhan included retired Allahabad High Court judge Justice Shashi Kant Agarwal and former UP Director General of Police K L Gupta, concluded that there was sufficient evidence of aided Dubey by local police, revenue, and administrative officials, and recommended an investigation against the “erring public servants”.
On July 10, last year, Dubey was killed in a “encounter”. A week ago, he and members of his gang attacked a Police team on its way to arrest Dubey. Eight policemen were killed in the ambush.
On the alleged collusion between Dubey and Officials, the Commission Report states, “Police and Revenue officers patronised him and his gang. If any person lodged any complaint against Vikas Dubey or his associates, the complainant was always humiliated by the Police. Investigation in any case lodged against them was never impartial.”
The Report states, “Sections relating to serious offences were dropped before filing the chargesheet. During the trial, most witnesses turn hostile. Vikas Dubey and his associates got bail orders from the Courts easily and quickly. State authorities never considered it appropriate to appoint a Special Counsel for his prosecution.”
After undertaking a regular inquiry, the Commission recommended that disciplinary procedures be initiated against the erring Public officials for the loss of records, particularly the record involving Vikas Dubey, and that appropriate directions be issued to those found guilty.
The encounters that murdered Prem Prakash, Atul Dubey, Amar Dubey, Pravin Kumar Dubey and Prabhat Mishra were given clean chits by the Commission.
The Report adds “Police fired at the accused in self-defence, leading to Dubey collpasing.”
