A Magistrate Court in Thane district’s Ulhasnagar in Maharashtra summoned Amit Agarwal, Vice President Amazon India based on a criminal complaint filed by a Mumbai-based lawyer for the offense of Cheating. (In Re: Amritpal Singh Khalsa v. Amazon.in & Ors.)
The Complainant Amrit Pal Singh Khalsa stated that he did not receive a product he had ordered through Amazon.
He stated that “Despite raising complaints through mails, regarding the non-receipt of the ordered product, he did not receive any satisfactory reply from the company nor a refund of the amount he had paid”.
Khalsa claimed that if his complaint is denied, he will be prejudiced while the accused will continue to commit such offenses. He alleged that when he approached the Ulhasnagar Police Station to file a complaint, the Police Officer denied to register an FIR.
The Complainant then approached the Judicial Magistrate in Ulhasnagar with a Criminal complaint for registration of FIR under Section 420 (cheating) of the Indian Penal Code.
Despite sending three notices, the accused did not appear the Police stated in front of the Magistrate. Thus in light of the facts presented the Judicial Majistrate SV Lad issued summons to the accused and ordered them to be present before the Court.
