The Supreme Court sought response of Central Board of Secondary Education (CBSE) to two Writ Petition filed by class 12 students who complained that their schools have failed to assess their results as per the 30:30:40 formula.
A Bench of Justice A M Khanwilkar and C T Ravikumari posted the Petitions to October 20, asking the CBSE to file their response. Advocate Rupesh Kumar, appearing for CBSE sought for time to file reply.
The Writ Petitions raised issue of failure in complying with the directions passed by the Apex Court on 17 June in Mamta Sharma vs CBSE and Ors. And 30:30:40 formula while declaring the result.
In Urvashi Naidu vs CBSE and Mohd Abraj v Holy Home Public School Nanauta Saharanpur UP and Ors, the Petitioner (Urvashi) argued that their marks haven’t been calculated on the basis of their real performance and as per the 30:30:40 formula of CBSE and the schools have deducted the marks on arbitrary basis.
In Mohd Abraj’s Petition, students asked for a scorecard with a report of detailed performance but no update have been provided.
The Top Court in a Petition filed on 17 June for cancellation of the Class 12 CBSE and ICSE exams incorporated the provision for Dispute Resolution, where a student could ask for correction of final result declared and will be provided a timeline for optional exams.
