Haryana’s private job quota law to come into effect from tomorrow

The controversial private sector quota law of Haryana’s government which will come into effect on Saturday (January 15), needs domiciled people to have the family identity card, Parivar Pehchan Patra, in order to register for employment under the law.

State government under the quota law spells out the requirement of Parivar Pehchan Patra for domicile people.

The assembly passed the Haryana State Employment of Local Candidates Bill on November 5, 2020 and it got signed by the governor on March 2, 2021. It gives 75 percent reservation in private sector jobs for those with a resident certificate (domicile). The law will be in effect for a time period of ten years.

The state government has also reduced the residency (domicile) requirement from fifteen to five years for an individual to obtain a Bona Fide resident certificate in the state, allowing private companies more flexibility in hiring.

The law which was modelled after another law implemented by Y S Jaganmohan Reddy government in Andhra Pradesh, has been labelled ‘regressive’ by the industry. The constitutional validity of the Andhra law has also been questioned in the High Court.

According to the Haryana State Employment of Local Candidates Rules, which were published on January 10, local candidates looking for employment under the Act must register on a separate website which is https://local.hrylabour.gov.in/.

An official while mentioning the law said that private sector hiring comes to a halt on January 15 which is the date from which the act will be effective.

Within three months of the Act’s implementation, every employer in the state will be required to register employees earning less than 30,000 in gross monthly salary or wages on the designated portal.  No one will be employed or engaged by any employer until all such employees have been registered on the designated portal.
