Court has directed the initiation of proceedings against a woman for falsely accusing four men of raping her. Acquitting the accused, the court emphasized the need to deal strictly with women who misuse the law to falsely implicate individuals in rape cases.
Additional Sessions Judge Jagmohan Singh presided over the case involving the four accused- Satish, Yogesh, Satbir, and Yogesh Gupta—who were accused of abducting and raping the woman in 2012. Upon reviewing the evidence, the court found it “highly plausible” that the woman had married accused Satish at an Arya Samaj temple in Delhi while concealing her existing marriage and child. Confronted by Satish, she falsely accused him and his relatives.
The court highlighted discrepancies in the woman’s testimony, noting her false claims of abduction and gang rape. Evidence, including testimony from a priest and a mobile phone voice recording, contradicted her account. The court deemed her testimony “patently false” and emphasized the need to address misuse of the law in such cases.
In its verdict, the court ordered proceedings against the woman under Section 344 CrPC for giving false evidence. It noted the prosecution’s failure to prove the charges against the accused beyond a reasonable doubt and acquitted Satish, Kuldeep, and Yogesh Gupta. Charges against Satbir were abated due to his death during the trial.
This ruling underscores the importance of upholding justice and integrity in legal proceedings, while also highlighting the need to address false accusations and misuse of the law.
