A 20-year-old man accused of raping, marrying and abandoning a 42-year-old women who is also a mother of a teenager was granted anticipatory bail.
The women told the court that she had divorced her ex-husband after she began a relationship with the accused in September 2018 and alleged that the accused forced her to have sex despite her repeated protests on pretext of marriage.
He called a ‘qazi’ and married her but used to intermittently, after a few days of marriage drop her off at her ex-husband’s house. In beginning of this year, he dumped her on grounds that his family did not accept their marriage.
She also claimed that he took 50gm of gold from her and pledged her bike due to financial issues. She further claimed that he was 26 years of age and submitted a fake Aadhar card establishing that he was born in August 2000 in court.
The court pointed out that the birth certificate copy showed the accused was 20 and said, “Police merely relied on supplementary statement of the women but never got verified facts about the boy’s age either from his school or municipal records”
Under such circumstances the court held that it is impossible for the accused to deceive the women who was married for 16 years and has a 12-year-old son.
It appeared to be a case of an ‘experienced married women’ taking advantage of an ‘inexperienced boy’ for selfish needs.
“Therefore, her contention that he deceived her and forcibly raped her on the night of September 21, 2018 appears to be prima facie an improper case” the court said.
