On June 13, Jamiat Ulama-i-Hind had filed a petition against demolition taking place by UP government against the rioter involved in riots took place after the comment on Prophet Mohammed was made.
The Petitioner seeks the Court to take strict action against those officers who are responsible for demolishing the house without following the process of law.
The Bench of Justice A.S. Bopanna and Justice Vikram Nath after hearing the petition gave oral remark that demolition cannot be a measure to retaliate and issued notice to file affidavit to UP government within three days.
The Court observed that, “Everything should look fair, we expect the authorities to act only in accordance with the law. Ensure safety so that nothing untoward happens,”
The UP government had filed the affidavit when everyone is raising question over their demolition drive run by CM Yogi Adityanath.
The government infirmed the Apex Court that the government is following due process of law and it nothing to do with rioting that took place in the state.
The government has taken action against the rioter under different statutes of the state and stated that the allegations of the petitioner are false and based on few media reports. The UP government urged to dismiss the petition.
The Senior Advocate Harish Salve representing the UP government in the matter submitted that media is creating hype over the demolition. However demolition is taking place with due process of law and notices were issued to people before the incident of rioting took place.
The Counsel further submitted that some people are trying to influence other people so that their illegal properties could be saved from demolition. The demolition is taking place without biases and prejudice, all the communities are treated equally.
