In a 425- page long counter affidavit the State government of West Bengal had stated that the pleas and allegations against government’s inaction in post poll violence and law-and-order situation in the State were frivolous and misleading.
The State said that these pleas were all politically motivated, quoting the names of Vice President of BJP South Kolkata and a member of the BJP legal cell.
In the affidavit, the State government has held that not all violence must be termed as post poll violence.
Further, it said that nobody could be driven out of their homes as it was their inherent right.
The Government went on stating that many other such pleas and PIL were sub judice in the High Court of Bengal and the Court has been passing effective orders.
The Government has assured that there was normalcy in the State after formation of Mamata Banerjee led TMC government. Since the uplifting of MCC (Model Code Conduct) the situation has been normal.
The State Government further mentioned having a mechanism of accepting online complaints and formation of a special team comprised of members nominated from National Human Rights Commission, West Bengal Human Rights Commission and the Member Secretary of West Bengal State Legal Service Authority.
Further, the Plea went on putting counter allegations and accusations on the petition stating that such accusations on the government were based on hearsay, fake news and misinformation.
However, the Government had acknowledged 16 murders in 15 incidents of post poll violence.
