On December 2, 2021 the United States Federal Appeals Court rejected the plea by the China Telecom Corporation which sought a halt in the order given by US Federal Communication Commission which blocked the corporation from providing its services in the United States.
The decision was made by a three-judge Panel of the United States Court of Appeals for the District of Columbia in which it declined the plea made by the United States agency of China Telecom Corporation to place a block in the order given by Federal Communication Commission which awaits a review of the legal challenge that it faces.
In its appeal the China Telecom Corporation argued that the corporation must give a pre-notification to its customers in the United States regarding the order of the Federal Communication Commission by December 4, 2021 and stated that it “…will be forced to cease significant operations, irreparably harming its business, reputation and relationship.”
The Federal Communication Commission stated that the China Telecom Corporation “is subject to exploitation, influence, and control by the Chinese government and is highly likely to be forced to comply with Chinese government requests without sufficient legal procedures subject to independent judicial oversight.”
The United States Court of Appeals observed that the matter regarding the block would be reconsidered in the Court for legal arguments but the consideration may take months to occur. The China Telecom Corporation was ordered by the Federal Communication Commission to stop its working in the United States on October 26, 2021.
