The Telangana High Court on Wednesday upheld the status quo in the case of the University of Hyderabad’s (UoH) possession of a block of property that has been in dispute for a long time.
The controversy dates back to 1982, when S Lingamaiah filed a lawsuit against the University of Hyderabad and then merged State of Andhra Pradesh in the Additional District Court of Rangareddy district.
The owner of land measuring approximately 25 acres in Survey No 14, 16 to 23 in Kancha Gahibowli, Serilingampally mandal, is seeking possession. The action was decided against the Institution in 1994.
As the area had no access road and was in the middle of the Institution, the University agreed to petitioner’s request to prove alternate land after careful consideration.
On December 24, 2003, the University’s Executive Council decided to donate around 12 acres of land between IIIT and Sports Village instead of 25 acres.
After the proposal was rejected by the Chief Secretary, the University consented to the decree holders’ request for other land and agreed to trade a 21-acre tract of land in Gopannapally in 2006, with the State’s assent.
However, the State reclaimed 25 acres of property in Gopanapally from the University and gave it to the decree holders in exchange for their 25 acres of land. The University was neither consulted or asked for its view prior to the publication of the aforementioned Government Order.
In 2009, the UoH filed a writ petition in response to the same, but the writ petition was dismissed.
UoH filed this writ appeal after being aggrieved by the same.
