Supreme Court grants Bail to Vinay Kulkarni in Murder Case

The Supreme Court on Wednesday granted bail to Vinay Kulkarni, a Former Karnataka Minister and a Congress Leader who was arrested on November 5, 2020, in relation to the murder of BJP worker, Yogesh Gowda.

While granting Kulkarni’s Bail application, a Bench of Justice UU Lalit and Justice Ajaj Rastogi has directed for producing Kulkarni before the concerned Trial Court within three days from today and ordered that bail be granted to him subject to the conditions imposed by the Court.

The Hon’ble Court has imposed the following conditions and any violation of these conditions shall result in cancellation of Bail.

Senior Advocate Mukul Rohatgi, who argued for Bail, drew the Court’s attention to the conflicting versions in the challans submitted by the Police and the CBI, in which the Local Police investigation dictated that a property dispute was the cause of the Murder, while the CBI investigation determined that Political rivalry was the cause of the crime.

Opposing the bail, Additional Solicitor General SV Raju appearing for the CBI argued that the case was of further investigation and not reinvestigation and that the State has the authority to order further investigation under Section 173(8) of the Code of Criminal Procedure Act, 1973.

ASG Raju further argued, “It has come on record that the Police was bribed by giving 2 lakh rupees. The witnesses were taken to a hotel & were tutored by the Advocates. All of this was there in the CBI’s investigation. Vinay Kulkarni has taken part in every step. Witnesses & police tampered, assailants were given refuge.”
