The Division Bench of Justice Indira Banerjee and Justice CT Ravikumar asked Union and State Government to response on the Writ Petition seeking protection of children from Sexual Harassment at Educational Institutions.
The Petition was filed by Nakkheeran Gopal, Editor, Publisher and Printer of Nakkheeran Tamil Bi-weekly, a Tamil investigative Journal stating that children has a Fundamental Right to Study in a Safe Environment which will be free from physical and emotional abuse.
The Petition states, “The future of the human civilization protecting their basic rights is of utmost importance when they are safety is take specially at educational institutions which is suppose it supposed to be the safest elder and that two during list of time it in the gates immediate concern and measures for intervention of paramount significance this cause for the implementation of legislative actions and community place interventions through virtual media to prevent a further rise in statistics and to ensure child posing a substantial thread to the future.”
Under Article 21 of Constitution guarantees that children has a fundamental right to dignity which got compromised when any predator attacks Children exposing them to sexual abuse.
The Petition further stated that online time can lead to grooming and both online and offline exploitation under the circumstances children can also themselves we coursed into becoming tools in furthers of illegal and dangerous activities.
Though the exploitation of children is increasing in educational premises no guidelines for it has been passed.
The Plea further states:
“With respect that the relevant organization including educational institution remains crucial department in the state government any lapse on the part of the educational institution would be considered the lapse on the part of the state government does on this score there is a vicarious liability upon the state government to implement any law for the well being and also for the protection of children in their respective States.”
