SC denies to intervene in Allahabad HC’s order of quashing NSA against Dr. Kafeel Khan

The Supreme Court of India has upheld the Allahabad High Court’s order of quashing the National Security Act (NSA) against Dr. Kafeel Khan, and setting him free from detention.

A three-judge bench headed by Chief Justice of India SA Bobde, also including Justices AS Bopanna and V Ramasubramanian, stated that there was no reason to interfere with the High Court’s order.

The bench said, “We will not interfere in the judgement. However, the observation will not impact any other proceedings.”

SG Tushar Mehta, for government, said that the High Court’s order takes the criminal proceedings away from Dr. Khan of Gorakhpur.

The bench responded by saying that the criminal cases can be taken based on their own merits.

Dr. Kafeel Khan was accused of provoking the public while addressing an anti-CAA rally at Aligarh Muslim University. He was imprisoned in Mathura jail for the same.

The Allahabad High Court had released him on September 1, 2020.
