On 30th November, 2021 the Supreme Court stated that it will pass orders for setting up of a medical board of doctors from All India Institute of Medical Sciences (AIIMS) to help Justice A. Amughaswamy of Commission of Inquiry (CoI), to help investigate the death of former Chief Minister of Tamil Nadu Jayalalitha in 2016.
A Supreme Court Bench of Justices S. Abdul Nazeer and Krishna Murari stated that it would allow the Apollo Hospitals to apply to the Commission of Inquiry (CoI) for the requirement of “rele examination of “relevant” witnesses and documents.
This was in regard to the Apollo hospitals moving to the apex court accusing that panel was biased and unjust.
The Apex Court opined that the order which would be given, should be having assurances given by the Commission of Inquiry, Apollo Hospitals and the Tamil Nadu State Government stating that the three would “cooperate for an early completion of the inquiry.”
The Tamil Nadu Government which is being represented by Senior Advocate Dushyant Dave, noted that it “would provide the Commission of Inquiry with a 700 sq. ft room with a dais to easily accommodate the proceedings and maintain its dignity.”
In the beginning of the case the State Government opposed to the various requests that were made by the Apollo Hospitals in an application, which is being represented by Senior Advocate Aryama Sundaram and Co-Counsel Rohini Musa.
In 2017, the State Government had appointed the Inquiry Commission which was headed by Justice A. Amughaswamy, to peruse the facts surrounding the death of former Chief Minister of Tamil Nadu Late Jayalalitha.
