A lawyer has approached the Kerala High Court against the Bharat Jodo Yatra led by Congress MP Rahul Gandhi seeking the regulation of traffic caused by the Yatra.
Advocate Vijayan K, petitioner, suggested in his submission that the Yatra could be carried out using half the road and leaving the other half of the road for the public and vehicles.
The Bharat Jodo Yatra, flagged off at Kanyakumari on 7th September, is now passing through Kerala towards the northern region through the several districts.
Gandhi is accompanied by KPCC office bearers, members of the Parliament, AICC leaders, Chief Ministers of other States and other members and supporters of the party.
It is submitted that Rahul Gandhi and his company are occupying the entire road, causing traffic and blockage for the general public, quoting Section 4(1) and 4(3) of the Kerala Public Ways (Restriction of Assemblies and Procession) Act, 2011,
“No person shall cause any obstruction by conducting any business or meeting or assembly or procession or demonstration on any public way or part therefor and sub-section 3 says that no demonstration or procession shall be conducted in such a manner that the entire carriageway or free flow of traffic is fully obstructed.”
The Petitioner highlighted the violations of sub-sections 1 and 3 of Section 4 of the Kerala Public Ways (Restriction of Assemblies and Procession) Act, 2011.
The petitioner also sought for an order directing the State and Police Force (Respondents) to take appropriate steps to realize the entire expenses incurred for the deployment of police forces in each district to cover the Bharat Jodo Yatra.
