The Kerala High Court ruled that those who share Driver’s Seats in auto-rickshaws are not protected by the Vehicle’s Insurance coverage.
When a person in the Driver’s Seat of an auto-rickshaw was Hurt, the Court found that the Insurance company was not obliged to pay any compensation. In truth, the Vehicle’s owner bore responsibility.
The Court stated that no one, whether a passenger or the vehicle’s owner, was allowed to share the driver’s seat, and that doing so was a Breach of the Vehicle Insurance Policy’s Terms.
The Court ruled that the driver of a three-wheeled goods cart could not share his seat with anyone else.
The Judgment was reached after Justice A. Badharudeen granted a Petition filed by a private insurance company challenging a Motor Accidents Claim Tribunal Order directing the firm to pay compensation to a person wounded while in the Driver’s Seat.
