Chief Justice Sanib Banerjee and Justice P.D Audikesavalu noted that no Transgender Candidate has so far applied for the vacancies notified by the Madras High Court and disposed of a Petition seeking a 1% Reservation for the Community.
A Transgender Rights activist Grace Banu Ganeshan advanced to the High Court demanding a special recruitment drive with the 1% Reservation for the Transgender Community.
The vacancies prevailed to the jobs of office assistants, watchmen, etc. with regard to Madras High Court service.
In response, Registrar filed a report showing that no Transgender Candidate came forward and applied to the vacant posts so far in the implementation process.
The Court upon going through the Registrar’s Report, inferred: “This Public Interest Litigation has worked itself out since there is no third gender application pursuant to the said notification.”
Madras High Court released this notification in accordance with the Reservation Rules under the Tamil Nadu Government Servants Act, 2016.
The applications were based on the assumption that the Transgender Candidates who apply will be deemed as a part of Most Backward Classes (MBC) even if they don’t own any Community Certificates.
Referring to all the above arguments the High Court asserted that, even if the Petition supports the commendable thought, it would be disposed off without provoking the Petitioner’s feelings and Rights and the Rights of the Transgender Community.
