The Madras High Court dismissed the petition filed by the BJP State Secretary K.Nagarajan which sought to reject the Tamil Nadu Government’s order for constituting a panel on the National Eligibility-cum-Entrance Test (NEET).
The committee directed to be headed by the retired High Court Judge, Justice A.K. Rajan, was aimed to study the impact of NEET on medical aspirants from backward classes of society.
Chief Justice Sanjib Banerjee and Justice Senthilkumar Ramamoorthy held, “The constitution of the committee does not amount to subverting any process of admission, far less an act of defiance to any order passed by the Supreme Court or pose even the remotest challenge to the exclusive authority of the Union to enact a law setting standards for higher education.”
The Court agreed to the idea of the constitution of the panel that, the study of the effect of NEET socially backward students could be beneficial to understand the issues and suggestions for alternate admission procedures, which would ultimately benefit the students.
The PIL filed by K. Nagarajan, against the order of the constitution of the committee was claimed to be unconstitutional, without any legal justification. The petitioner contended that the order was against the procedures defined under the National Medical Commission Act, 2019.
“As long as the state government did not infringe upon the exclusive domain of Section 14 of the National Medical Commission Act, this court cannot interfere in the matter. Courts cannot rush in and interdict notifications or the steps taken with regard to its policy or garnering public opinion or the like,” the Court said and dismissed the PIL.
