A Legal Advisor for the Commissioner of Delhi Police will now be considered to be a part of the Commissioner of Police (CP) Secretariat.
There would be no case sent to the Supreme Court without acknowledging the legal comments from the Legal Advisor.
In an Order passed by Romil Baaniya who is the officer on special duty to the commissioner at the CP secretariat, it was mentioned that as the secretariat started functioning at the Police headquarters for streamlining and better monitoring of legal/court matters, it has decided to include the legal adviser in it.
The Order stated that “All special commissioners of police, joint commissioners and DCP/legal cell shall closely examine the court/legal matters, including writ petitions (civil and criminal), civil suits, original applications, affidavits, on behalf of the CP and shall also obtain specific legal opinion/comments from the legal adviser.”
The responsibilities of a Legal Advisor would be to give its advice in the departmental, civil and criminal cases, personally looking into all matters in which notices have been made to the commissioner, will file reports, revisions and applications and will examine all the pronounced judgements on any service matters before implementation.
The responsibilities of a Legal Advisor further included administering the National Security Act and MCOCA proposals, access the replies to be filed before Central Information Commission in the matters related to Right To Information and clear facts, comments and counter-replies would be filed in the Court and agreements of contracts with firms.
