Gold Smuggling Case: Kerala HC upholds Preventive Detention of Prime Accused

The Kerala High Court on November 09, 2021 decided to not make any changes in the Preventive Detention of Rabins Hameed who is the prime Accused in the ‘Gold Smuggling’ case of Kerala. 

The Division Bench of Justices AK Jayasankaran Nambiar and Mohammed Nias CP rejected the Plea of Fousia Hameed, wife of Rabins Hameed asking for revocation of the Prevention Order.

Rabins K. Hameed was Arrested by the National Investigation Agency (NIA) on October 26, 2020, is still in detention under the Conservation of Foreign Exchange and the Prevention of Smuggling Activities Act (COFEPOSA), 1974.

The Case is concerned with the seizure of 30 kilograms of gold in July 2020 that was being smuggled to India in the bathroom fittings of a Cargo ship in one of the consignments concealed as Diplomatic baggage of the United Arab Emirates (UAE). 

The Case was then handed over from the Customs Department to the National Investigation Agency (NIA) which Accused Rabins Hameed of being one of the main Funders and Masterminds of the Conspiracy.
