Embezzlement case: Allahabad HC directs applicants to surrender within 60 days for bail consideration

The Allahabad High Court had rejected the anticipatory bail petition of Geeta Singh and her husband in a case concerning the misappropriation of Rs1,08,40,760. The accused had sought bail in a case under  sections 409, 419, 420, 467, 468, 471 of the Indian Penal Code.

The High Court Bench of Justice Siddharth was hearing the matter under section 438 of the Code of Criminal Procedure. The Bench rejected the bail plea on the absence of any grounds for providing anticipatory bail.

The Court also ruled that if the accused surrender by themselves before the Court within 60 days then their bail application would be considered. It further ordered that no coercive action against them should be taken until the aforementioned period.

However, the Court granted permission for taking coercive action if they have not surrendered within the said 60 days. No more extension would be provided to the accused, the Court clarified while disposing of the petition.

The accused, Geeta Singh, who is a Village Pradhan, is alleged to have been guilty of misappropriating a sum of Rs. 1, 08, 40, 760 along with other co-accused including her husband.
