Delhi High Court by a single bench of Justice Suresh Kumar Kait has listed the final hearing of the plea filed by BJP MP Subramanian Swamy challenging the Trial Court order on July 30.
In the plea, Subramanian Swamy pursued summoning of various documents and witnesses in National Herald case against Congress president Sonia Gandhi, her son Rahul and others.
Swamy had sought summoning of certain witnesses, including the Secretary General (registry officer) of the Supreme Court, a deputy land and development officer and a deputy commissioner of Income Tax and also to issue directions to them to prove that certain documents were part of the case.
Swamy had moved the High Court against a Trial Court order dated February 11 which stated that Swamy’s application under Section 244 of the Criminal Procedure Code (CrPC) to lead evidence would only be considered after his examination in the case.
On February 22, The High Court promulgated notices and sought responses of Gandhi’s AICC general secretary Oscar Fernandes, Suman Dubey, Sam Pitroda and Young Indian (YI) on Swamy’s plea and had also stayed the Trial Court proceedings in the case till then.
The case is related to a private criminal complaint in the Trial Court, wherein, the BJP leader had accused the Gandhi’s and others of conspiring to cheat and misappropriate funds by paying only INR 50 lakhs through which Young Indian Pvt. Ltd (YI) had obtained the right to recover INR 90.25 crore which the Associate Journals Ltd, owner of National Herald, owed to the Congress.
