Observing that individuals are concerned about Data Sharing on Meta, the Delhi High Court remarked that someone should look into it.
A Bench of Justices Rajiv Shakdher and Poonam A Bamba also mentioned Cambridge Analytica, a UK-based corporation under Investigation for Allegedly Unlawfully gathering Data from Facebook users, and questioned the element of Data Sharing in Facebook’s Closed Groups.
The Court is hearing WhatsApp and Facebook’s appeals against a Single-Judge Judgement that declined to suspend the Competition Commission of India’s investigation into the instant messaging platform’s revised Privacy Policy.
The hearing on the Appeals was extended until July 21 due to a request by WhatsApp’s Senior Counsel to suspend the matter for a period of time so that the proposed Data Privacy Laws could be debated in Parliament.
WhatsApp’s senior Lawyer, Harish Salve, said that the Messaging Network does not look at messages and only possesses External Information such as phone number and amount of transaction.
On May 6, 2021, the High Court’s Division Bench issued Notices on the Appeals and requested the Centre to respond.
