The Delhi High Court refused to entertain the Public Interest Litigation seeking High-Level Inquiry against Chief Minister of Delhi Arvind Kejriwal and Aam Aadmi Party (AAP). It was Alleged that they have links with Khalistani Separatists.
The Division Bench comprised Acting Chief Justice Vipin Sanghi and Justice Navin Chawla. It remarked that the Plea was ‘Frivolous’. It asked the Counsel for the Petitioner to not file such Petitions.
The Plea filed by Congress Leader Jagdish Sharma sought an Investigation Alleging that Aam Aadmi Party and Mr Kejriwal have links with the Banned Khalistani Organization Sikhs For Justice (SFJ), and that they received Funds from the Banned Organization.
It further sought Suspension of Recognition of Aam Aadmi Party, and a Ban on it from contesting Elections until the Inquiry takes place.
The Plea referred to a Letter Written by the former Chief Minister of Punjab Charanjeet Singh Channi, wherein similar Allegations were made. It also referred to the Statement of Kumar Vishwas (Founding Member of the Aam Aadmi Party), which mentioned the connection of Mr. Kejriwal with the Separatist groups.
It added that Union Home Minister Amit Shah after considering the seriousness of the letter had assured Channi of a thorough Investigation.
Advocate Rudra V Singh representing the Petitioner said that even though an assurance was given by Mr. Shah and concerns were expressed by Prime Minister Modi, no Enquiry has been initiated by the Centre yet.
