The Delhi High Court recently ordered the blockage of the website www.myshoeshop.in, which was operating a business selling first-copies of well-known shoe brands including Nike, Adidas, Louis Vuitton, and New Balance at steep discounts.
According to Justice Navin Chawla, New Balance has successfully established a prima facie case for the grant of an injunction. The Court noted that if the website was not stopped by an ad-interim order, the plaintiff and the consumers would suffer irreparable harm.
After reviewing the website’s contents, the court determined that it was clearly evident that the defendant was violating not just New Balance’s trademark rights but also those of other well-known companies, including Nike, Adidas, and Louis Vuitton.
The Court also requested the KYC documents as well as all other information pertaining to the three phone numbers used by the aforementioned website to sell “first copies” and other information.
The Court further opined, “Accordingly, the defendant no. 2 is directed to provide contact details/addresses of the proprietor/registrants of the website www.myshoeshop.in. It is further directed to deactivate/block the said website till further orders.”
“The defendant nos. 7 and 8 are also directed to issue necessary directions for blocking of the said website forthwith”
The defendant’s Instagram feed was suspended by the court as well. The defendant was given 30 days to file a written statement after the Court issued summonses in the case.
Therefore, the Court directed that “www.myshoeshop.in” be blocked pending further orders.
The next hearing will take place on November 9.
