The Delhi Court directed the AAP MLA and Delhi Cabinet minister, Imran Hussain, to submit documents proving his claims, that he has been procuring oxygen gas from outside Delhi and rented the cylinders from a seller in Delhi.
The Delhi High court has asked the Delhi government whether Imran was supplied any oxygen through refillers for state quota, who were provided gas for individuals in-home care, hospitals and ambulances.
The court also asked senior advocate Rajshekar Rao, who is the amicus curiae of the court for the matter to verify the documents
The Bench comprising of Justices Vipin Sanghi and Rekha Palli was hearing an application alleging that Hussain has been hoarding oxygen cylinders and making “arbitrary distribution”.
On 7th May, the court had issued a notice to Hussain and asked him to remain present.
Senior Advocate representing Hussain contended that an impression that Hussain’s act is a harm to society is being made, however, he told the court that he is ready to submit the document of the receipts of the gas refills from outside Delhi.
However, as the receipts were not on record, the court asked the MLA to show the documents in support of his claims and listed the matter for hearing on May 13.
The court stated that it would be a concern if Hussain is found procuring oxygen from the quota allocated to hospitals, if not then there is no issue in providing oxygen from outside Delhi, as even Gurudwaras are doing the same.
The court further remarked that “So far as medicine is concerned for which they require a license, there is a violation of that law. There is no such prohibition on cylinders. If they are dipping into the pool allocated for hospitals, then it’s objectionable. If they are getting from outside, then there is no issue.”
