In a significant decision, the Ernakulam District Consumer Disputes Redressal Commission has ruled in favor of Karthik Mohan, Deputy Manager at Bosch India Pvt., ordering Southern Railway to compensate him for the inconvenience caused by a 13-hour delay of the Alleppey Express.
Karthik had purchased a ticket for the express train to attend a crucial company meeting in Chennai. However, the extensive delay led to his missing the vital event, resulting in substantial disappointment and financial loss.
The commission acted swiftly by instructing the railway to pay Rs. 60,000 as compensation to address the difficulties faced by the passenger. The railway defended itself by asserting that the passenger had not communicated the purpose of the journey, which would have allowed them to take necessary precautions. However, the court rejected this argument, holding the railway responsible for the prolonged delay and its repercussions.
The commission further mandated the railway to provide Karthik Mohan with Rs. 50,000 in compensation, in addition to Rs. 10,000 to cover court expenses. The railway has been given until the end of this month to comply with the order and fulfill its financial obligations.
This ruling emphasizes the importance of punctuality and timely transportation for railway services. Neglecting these responsibilities can result in financial consequences for the parties at fault.
