In a plea which challenged the exclusion of NCLT members from the subsequent Tribunals Reforms (Rationalisation and Conditions of Service) Ordinance, 2021 and the Eighth Schedule of the Finance Act, 2017, Tribunal, Appellate Tribunal and other Authorities (Qualifications, Experience and other Conditions of Service of Members) Rules, 2020 and the benefits under the act, the ASG told the SC that the Union Government is in coordination with the concerned departments.
The ASG assured the Bench comprising of Justices DY Chandrachud and AS Bopanna that the situation would be sorted within a period of 2 weeks or else a counter affidavit would be filed regarding the matter. The petition was filed by a member of the NCLT.
The petition submits in its submission that the exclusion of the members of NCLT is arbitrary, unreasonable, and illegal, and it violates Articles 21, 19, and 14 of the Constitution.
It has been underlined that while the NCLT members are deprived of the statutory benefits, the same has been extended to the members of NCLAT and other tribunals.
