The Calcutta High Court has rejected a Section 482 CrPC application filed by a wife seeking to quash criminal proceedings initiated against her under Section 306 IPC for abetment to her deceased husband’s suicide.
The deceased’s younger brother filed an FIR, alleging severe mental torture by the petitioners. The police and complainant relied on a “suicide note” left by the deceased, purportedly implicating the petitioners.
Justice Rai Chattopadhyay, noting a prima facie cognizable case, declined to quash the proceedings, stating that only genuine perceptions are revealed before death.
The trial court is directed to commence the trial within four weeks.
