The Division Bench of Justice Milind Jadhav and Justice Abhay Ahuja has asked the Maharashtra State Government to consider the representation made by law students for uniform exam pattern and method all over the State and Director of Higher Education Department, Maharashtra to take decision on law students’ representation.
The Court observed that Petitioner wants to enforce the decision taken in the meeting held between the Minister of Higher and Technical education, Maharashtra and Vice Chancellors of all the State Universities.
In this meeting it was decided that exams will be held offline and in the MCQ form but all Universities are not following this decision.
Advocate Uday Warunjikar representing Petitioner stated that their representation was also pending before the Principal Secretary and the State Ministers though it was beneficial for all.
In response, Respondent claimed that in many Universities’ exams are already started. The Petitioner said to issue directions for such universities where exams are not yet started.
The Petitioner claimed that Writ of Mandamus should be issued to follow uniform pattern of exam and declaration of result on time.
The University of Mumbai as claimed by the Petitioner that offering both the mode of examination i.e. offline and online depending upon course. Only three Universities namely Gondwana University, Rashtrasant Tukadoji Maharaj Nagpur University, Kavayitri Bahinabai Chaudhri North Maharashtra University and Jalgaon following the decision of conducting offline exams in MCQ form and rest are holding descriptive examination.
If the exams in Maharashtra were held late then due to delay in results students who want to take admission outside the State will suffer as deadlines will be crossed as claimed by Petitioner and so the Plea was made to declare the results timely.
