Bombay HC: Clarify if IPS Rashmi Shukla named as Accused in Phone Tapping Case

The Bombay High Court on Thursday, asked the Mumbai Police to clear their stand on whether they want to make senior IPS officer Rashmi Shukla as an Accused in a Case of illegal phone tapping.

The Court directed them to clarify the name of Rashmi in the case of illegal tapping and leaking of confidential documents which was related to Transfers and postings of Police Personnel in Maharashtra.

A Division Bench comprising Justices Nitin Jamdar and Sarang Kotwal ordered the Police to educate the Court about the progress made in the probe by October 25.

The Plea filed by Rashmi requested the Court to subdue the FIR and order to move the Investigation of the Case to the CBI.

While Advocate Mahesh Jethmalani appearing for Rashmi pointed on the Affidavit filed by the Police in which they haven’t stated Shukla as an accused in the FIR.

Contrarily, senior Counsel Darius Khambata appearing for Police informed the Court that Shukla has not been identified as an Accused yet, but the investigation is going on to determine person responsible for the leak.

After hearing both the sides, the Court stated that if Rashmi hasn’t been identified as an Accused and if the Police don’t want to identify her as one, then there is no use of hearing this Petition and wasting time on it.

“If she (Shukla) is not going to be named as an accused, then why should we hear this petition? We are only on (the point of) not wasting judicial time,” stated the Bench said.

“You (police) clarify whether or not she is going to be named as an accused. Then, as and when she is named as an accused, she can move the court again,” added the Bench.

Through her Plea Shukla accused that she was being targeted by the Maharashtra Government because she submitted a report on their Corruption happening in Police Department.

Shukla is currently serving as the Additional Director General of the Central Reserve Police Force’s (CRPF) South Zone claimed to expose the corruption involved in assigning postings to Police Officers.

BKC Cyber Police station in Mumbai registered an FIR against few unidentified persons for tapping phones illegally and revealing Documents and Information.

The matter is Adjourned and has been listed on October 25 for further Hearings.
