Andhra Pradesh HC grants Stay on Single Judge Order on Fee Reimbursement Scheme

Andhra Pradesh High Court put a Stay on the Single Judge Order on the Jagananna Vidya Deevena Scheme. The Court directed the State government to pay fee reimbursement to the colleges directly instead of paying it to the mothers of the students.

An Appeal Petition was filed by the Government after the High Court turned down the Review Petition on the issue. The High Court Bench comprised of Chief Justice Prashant Kumar Mishra and Justice M Satyanarayana Murthy.

The private college managements argued in the High Court that the students failed to pay the fee despite it being reimbursed by the Government as the amount was being paid to the mothers under the reimbursement scheme after changes had been made to it by the Government. They also argued that the Government directed them not to insist the students to pay the fee.

The changes brought to the scheme by the Government ensured accountability and transparency, and safeguards were put in place to make sure that students do not default the fee stated Advocate General S Sriram. He also stated that the Government has taken measures wherein if a student failed to pay the first installment then the second installment would be directly paid to the college.

The Bench stated that the colleges cannot demand upon the implementation of Government schemes in a particular manner and that they did not have a say in the matter.

An Interim Stay was granted and the colleges were directed to file Counters.
