The Allahabad High Court has rejected the argument of a petitioner to dispose the dead bodies near Ganga River in accordance to the religious rites thereby questing back, “Why should the State do that? If there is a death in a family, is it state’s responsibility?”
The Court further questioned the petitioner for his contribution, till now, for the dead bodies buried near Ganga thereby calling his petition to be in the nature of Public interest litigation and not in public interest.
Furthermore, heavy costs were being imposed on the petitioner for approaching the Court without having any detailed study on the matter.
The court stated that there are different practices done by various communities in different formats which require a lot of research work and hence the State cannot be liable for the same.
In conclusion, the Court despite rejecting the petition stated that the same can be filed again with some additional research work.
